Terms and Conditions
Students enrolled at programs run by Avida Educational Trust shall be subject to these terms and conditions.
General Terms
o It is accepted that these terms and conditions were read by the applicant prior to making an application
o Students/Parents agree to be bound by these terms
o Once enrolled, it is the parent's responsibility to bring the child for the classes on time and on a regular basis
Pre Application Enquiries
o It is the responsibility of prospective students and parents to ensure that the course they are applying for (via website or at the location) is the course they want to study.
o Students/Parents must research the course contents, duration and fees as Avida Educational Trust cannot be held responsible for any error on the part of applicants.
o Nor will Avida Educational Trust be obliged to refund any fee paid on the basis that the course is not what was expected
Termination of Admission
Offers of admission are made on the basis of information supplied by the applicant (Student/Parent). Students/Parents warrant that such information is accurate. Avida Educational Trust is entitled to terminate a student’s admission, without refund of fees, if the information supplied by an applicant is proven to be false or misleading
Course Cancellation
o Courses offered are subject to a minimum number of students and tutor availability.
o If a course has less than the minimum number of students desired by Avida Educational Trust or has no available tutor, Avida Educational Trust is entitled to cancel such a course, at its absolute discretion, without liability.
o In such instances, Avida Educational Trust can offer the student an alternative course of the same level or standard
o Avida Educational Trust will refund program fees if the student declines an alternative suitable course or in the instance of no alternative courses being available
Program Fees
Students are required to pay the relevant program fees prior to commencement of the course as detailed in the confirmation mail sent on initial registration. All program fees or deposit must be paid to Avida Educational Trust:
o Cheques and demand draft must clear before final admission is confirmed
o Avida Educational Trust accepts no responsibility for any fees deposit paid to an agent or to a third party except for approved partner locations
o Failure to attend classes does not relieve students of responsibility to pay the fee
o Applicant/Parent may need to pay additional fees for certain workshops and those will be communicated to them in advance by Avida Educational Trust
Refund of Program Fees
Paid program fees are refundable at the discretion of Avida Educational Trust under the following conditions:
o The batch/program gets cancelled due to the unavailability of a tutor or location or minimum batch size
o Avida Educational Trust will process any legitimate refund within 3 months
Deferrals/ No Shows/Dismissal for Poor Attendance
o Where an enrolled student wish to defer his admission or take a break without intimation or miss classes without intimation fees paid will not be refunded
o No refund of fee paid, save as provided for in this agreement, where the student does not turn up (no shows)
o Avida Educational Trust reserves the right to terminate a student’s admission without any refund for deferrals/no shows/poor attendance/poor conduct/non payment of fees within due date or any other valid reason. No Refund, whatsoever.
Non Attendance/Missed Classes
o It is the parent's responsibility to bring the child to the class on time and on a regular basis. No compensation will be provided for missed classes.
Payment delay
In case of a delay in payment, for every week of delay in payment you will be charged a penalty of Rs. 200/- per child. Beyond three weeks of delay in payment from the due date the enrolment in the program will be cancelled without any refunds, whatsoever.
Once a child is registered in the program, it is valid only for a week within which the fee for the program should be paid to enroll the child in one of Avida's programs. If not, the registration fees will have to be paid again at the time of enrolment.
Voluntary Withdrawal by Student
If a student voluntarily withdraws from a program a pro-rated refund post any applicable deductions will be paid.
Changing Courses/Batches
Any application for change of course module must be made by the applicant/parent in writing. This must be submitted to Avida Educational Trust not more than 4 weeks into the course for which the student is enrolled. Permission may be given, at the discretion of Avida Educational Trust and subject to availability on the following terms:
o If the program fee for former course is less than that for the new course, the student agrees to pay the difference. If it is higher than the new course, Avida Educational Trust will not refund the difference.
o There is an availability of the requested course at the venue requested
Avida may also, at its discretion, based on a student assessment/other reasons shift a child into a different batch after informing the parents of the same.
Course Material
o Course teaching material will be supplied by Avida Educational Trust at its discretion and are fully copyrighted
o No part of the course material shall be copied or reused without permission, for any training programs, other than those authorized by Avida Educational Trust
Course Artifacts, Photographs and Videos
o The artifacts created as part of the hands on sessions by the participating students are copyright of Avida Educational Trust. This may be used for promotional purposes for its programs
o Photographs and Videos of the participants of the courses are also copyright of by Avida Educational Trust and may be used for similar promotional purposes
o None of the materials or photographs will be shared with any third party under any circumstances.
Validity
The invalidity or unenforceability of any part of this agreement shall not affect the validity or unenforceability of the remainder

- If you miss 3 consecutive classes without informing the concerned person at the Sparkling Mindz Center you will forfeit your seat in the program and your program fee paid, post which you will have to re-register by paying Rs. 500/- and pay the fees for the program to continue
- If you inform the concerned person at the center in advance regarding a break, we will keep your paid fee valid for a maximum of 3 months from the date of information. Post which your fee paid to us will lapse and you will have to re-register by paying Rs. 500/- and pay the fees for the program to continue. Your child will also be re-assessed to determine level upon re-admission
- If you miss classes and fail to inform us, you are liable to pay the program fees for those classes and no waiver will be provided
- If you miss classes and inform us about a break/inability to bring your child after 3 consecutive missed classes you are still liable to pay the program fees for the missed classes
